Welcome to Al Mada Specialized for Digital Innovation ("Al Mada" or the “Company” or “We”) via our digital platform application (the “Mada BNPL”) providing Buy Now, Pay Later services through its platform. Please read these Terms and Conditions carefully before creating an account or using the “Buy Now, Pay Later (BNPL)” services. Creating an account, using the service, or electronically approving any payment plan shall constitute the user’s acknowledgment that they have read, understood, accepted, and agreed to be bound by these Terms and Conditions. The user further acknowledges that they have reviewed and agreed to the Privacy Policy and the data processing mechanisms adopted by Al Mada, and in accordance with the applicable laws and regulations in force in the Hashemite Kingdom of Jordan.
If you do not wish to accept or agree to these Terms and Conditions, you are requested to refrain from using the service.
Al Mada reserves the right to amend these Terms and Conditions from time to time in accordance with the applicable laws and regulations in force. Users shall be notified of any material amendments promptly upon their entry into effect through the application. You understand and agree that your continued access to or use of the Mada BNPL after the effective date of modifications to the Terms indicates your acceptance of the modifications.
Al Mada reserves the right to amend these Terms and Conditions from time to time in accordance with the applicable laws and regulations in force. You shall be notified of any material amendments immediately upon their effective date through the application.
Parties:
"You" and "your" refer to you as a user of the Mada BNPL. A "user" is someone who creates an account or uses the “Buy Now, Pay Later (BNPL)” services provided by Al Mada, browses, crawls, scrapes, or in any way uses the Mada BNPL.
Content:
"Content" means text, images, photos, audio, video, location data, and all other forms of data or communication. "Your Content" means Content that you submit or transmit to, through, or in connection with the Mada BNPL, such as ratings, reviews, compliments, invitations, check-ins, messages, and information that you publicly display or displayed in your account profile. "User Content" means Content that users submit or transmit to, through, or in connection with the Mada BNPL. "Company Content" means Content that we create and make available in connection with the Mada BNPL. "Third Party Content" means Content that originates from parties other than Al Mada or its users, which is made available in connection with the Mada BNPL. "Mada BNPL Content" means all of the Content that is made available in connection with the Mada BNPL, including Your Content, User Content, Third Party Content, and Al Mada Content.
BNPL Service:
A financial arrangement allowing customers to purchase goods or services and pay for them over time in payments.
Payment Plan:
The schedule and terms under which payments are to be made.
Merchant:
A third-party seller offering goods or services through Al Mada platform.
User Account:
The personal account created by a user to access Al Mada's services.
Credit Assessment:
The process by which Al Mada evaluates the creditworthiness of a user before extending BNPL services.
Platform:
The website, mobile application, or any digital interface provided by Al Mada through which the Services are offered.
Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they are taken as interchangeable and therefore as referring to the same.
We employ the use of cookies. By accessing our Mada BNPL, you agree to use cookies in agreement with Al Mada’s Privacy Policy. Cookies are used by our Mada BNPL to enable the functionality of certain areas to make it easier for people visiting our Mada BNPL. Some of our affiliate/advertising partners may also use cookies.
Ownership:
Al Mada owns all Content, including but not limited to visual interfaces, interactive features, graphics, design and compilation, including, but not limited to, our compilation of User Content and other Mada BNPL Content, computer code, products, software, aggregate user review ratings, and all other elements and components of the Mada BNPL excluding Your Content, User Content and Third Party Content. Unless otherwise stated, Al Mada and/or its licensors own the intellectual property rights for all materials on the Mada BNPL. All intellectual property rights are reserved. You may access this from the Mada BNPL for your own personal use subjected to restrictions set in these Terms. We also own the copyrights, trademarks, service marks, trade names, and other intellectual and proprietary rights throughout the world ("IP Rights") associated with the Al Mada Content and the Mada BNPL, which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. As such, you may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of the Content in whole or in part except as expressly authorized by us. We do not grant you any express or implied rights, and all rights in and to the Mada BNPL and the Al Mada Content are retained by us.
Advertising:
Al Mada and its licensees may publicly display advertisements and other information adjacent to or included with Your Content. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising.
Other:
User Content (including any that may have been created by users employed or contracted by Al Mada) does not necessarily reflect the opinion of Al Mada. We reserve the right to remove, screen, edit, or reinstate User Content from time to time at our sole discretion for any reason or no reason and without notice to you. We have no obligation to retain or provide you with copies of Your Content, nor do we guarantee any confidentiality with respect to Your Content.

By creating an account or using our services, you expressly authorize Al Mada to conduct creditworthiness assessments, identity verification, fraud screening, or other due diligence processes, either directly or through authorized third-party service providers such as but not limited to CRIF and Sanad.
Al Mada retains the sole discretion to approve or deny access to its services, including BNPL offerings, based on internal eligibility, underwriting, and risk-assessment criteria. Such determinations may include, without limitation, reviews of user history, financial behavior, or non-compliance with these Terms.
You may not access or use the Mada BNPL or BNPL services if:
Access to BNPL services may be further subject to the Company's risk and underwriting policies, applicable law, and any regulatory directives in force in the user’s jurisdiction.
User Representations and Warranties:
By using the Mada BNPL, you represent and warrant that all information you provide is true, accurate, and complete, and that you have the legal capacity to enter into this agreement and comply with these Terms.
Permission to Use the Mada BNPL:
We grant you permission to use the Mada BNPL subject to the restrictions in these Terms. Your use of the Mada BNPL is at your own risk.
Mada BNPL Availability:
Al Mada may modify, update, suspend, or discontinue some or all of the “Buy Now, Pay Later (BNPL)” services at any time where operational or regulatory needs require such action. Such modifications, suspension, or termination may be carried out with prior notice where reasonably possible, and without any obligation or liability towards the user.
User Accounts:
You must create an account and provide certain information about yourself in order to use some of the features that are offered through the Mada BNPL. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account. Al Mada reserves the right to suspend or close the user’s account in the event of a breach of these Terms and Conditions, or where there is reasonable suspicion of fraud, illegal activity, or any legal or regulatory obligation requiring such action.
Mediums of Communications:
By creating an account, you agree to receive certain communications in connection with the Mada BNPL. You will also receive our e-mail newsletter about happenings in our business.
You represent and warrant that:
We are entitled to all of the rights to the content that you post on our Mada BNPL and have all necessary licenses and consents to do so; that the use and comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party; the Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy; and the use and comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity. Al Mada reserves the right to monitor all use and comments and to remove any comments which can be considered inappropriate, offensive or causes breach of these Terms.
By posting content or submitting material, and unless we indicate otherwise, you hereby grant Al Mada a non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, display, and authorize such content for others to use, reproduce and edit any of your comments throughout the world in any media now known or later developed.
Your Privacy:
Al Mada’s Privacy Policy, as it may change from time to time, applies to the collection and use of your information and is made a part of these Terms by this reference. While we take appropriate technical and organizational measures to protect your data, no system is completely secure. In case of any breach of your personal data, we will notify you without undue delay as required under applicable data protection laws.
This section sets forth the specific terms and conditions applicable to Al Mada Specialized Finance Company’s Buy Now, Pay Later (“BNPL”) product offering (the “BNPL Services”). These provisions form an integral part of the overarching Terms and Conditions and shall be read in conjunction therewith.
Eligibility and Approval Criteria:
Access to the BNPL Services is contingent upon satisfaction of Al Mada’s internal eligibility, underwriting, and risk-assessment procedures. By applying for or using BNPL Services, the User consents to Al Mada:
Approval to utilize BNPL Services is granted at the sole and absolute discretion of Al Mada. Al Mada shall not be under any obligation to disclose the rationale for any refusal or revocation of access. Al Mada reserves the right to withdraw its approval at any time, and suspend its services to any Users as it deems appropriate.
Payment Structure:
Upon approval, Users may elect to finance eligible transactions through payment plans disclosed at the point of sale. Each plan shall specify:

Delinquency, Late Fees, and Default:
In the event the User fails to remit any payment within the prescribed grace period (if any), Al Mada shall be entitled to:
Suspension or Revocation of BNPL Privileges:
Al Mada reserves the right, at its sole discretion, to suspend, restrict, or terminate access to the “Buy Now, Pay Later (BNPL)” services in the event of any breach of these Terms and Conditions, or where there are regulatory or legal requirements, or fraud risk concerns. Such actions may be taken with notice to the user where reasonably possible, including but not limited to the following cases:
The User shall remain liable for any outstanding balance notwithstanding such suspension or termination.
Voluntary Early Settlement:
The User may, at any time and without penalty, prepay the full outstanding balance under an active payment plan. Upon receipt of the full balance, Al Mada shall deem the relevant BNPL agreement fully satisfied and issue a corresponding acknowledgment to the User.
Merchant Disputes:
The user may submit an objection or complaint regarding the product or service subject of the transaction. Al Mada shall review such cases in accordance with its applicable policies and procedures, and in line with the return, exchange, and refund policies adopted by the relevant merchant, without prejudice to the user’s outstanding financial obligations, unless otherwise agreed. . The existence of any such dispute shall not suspend, offset, or extinguish the User’s payment obligations toward Al Mada.
Amendments to BNPL Terms:
Al Mada reserves the right to amend, revise, or update these BNPL Service Terms at any time in accordance with applicable law or internal policy, the User is responsible for regularly reviewing the Terms to stay informed of any changes. Continued use of the BNPL Services following such changes shall constitute acceptance of the revised terms. No amendment shall apply retroactively to existing payment agreements unless expressly stated and agreed upon by the User.
We are under no obligation to enforce the Terms on your behalf against another user. While we encourage you to let us know if you believe another user has violated the Terms, we reserve the right to investigate and take appropriate action at our sole discretion.
You agree not to, and shall not assist, encourage, or enable others to use the Mada BNPL to:

You may terminate the Terms at any time by closing your account, discontinuing your use of the Mada BNPL, and providing Al Mada with a notice of termination.
We may close your account, suspend your ability to use certain portions of the Mada BNPL, and/or ban you altogether from the Mada BNPL for any or no reason, and without notice or liability of any kind. Any such action could prevent you from accessing your account, the Mada BNPL, Your Content, Mada BNPL Content, or any other related information.
By visiting Al Mada Mada BNPL, you acknowledge that the laws of the Hashemite Kingdom of Jordan will govern these Terms, as well as any claim, cause of action or dispute that might arise between you and Al Mada (a "Claim"), without regard to conflict of law provisions. FOR ANY CLAIM BROUGHT BY EITHER PARTY, YOU AGREE TO SUBMIT TO THE PERSONAL AND EXCLUSIVE JURISDICTION OF THE COURTS OF AMMAN (PALACE OF JUSTICE), AND WAIVE ANY OBJECTION TO VENUE OR FORUM NON CONVENIENS.
The Company shall not be held liable for any delay or failure in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, riots, embargoes, civil or military authority actions, natural disasters, or failure of telecommunications or internet service providers.

If you belong to the organizations mentioned under Paragraph C above, and are interested in linking to our Mada BNPL, you must inform us by sending an e-mail to Al Mada. The e-mail should include your name, your organization name, contact information, the URL of your Mada BNPL, a list of any URLs from which you intend to link to our Mada BNPL, and a list of the URLs on our Mada BNPL to which you would like to link. We shall respond within two (2) to three (3) weeks.
However, any approved organization may hyperlink to our Mada BNPL as follows:
You may not create frames around our Mada BNPL that alter in any way the visual presentation or appearance of our Mada BNPL without our prior written approval.
We shall not be held responsible for any content that appears on your Mada BNPL. You agree to protect and defend us against all claims that is rising on your Mada BNPL. No link(s) should appear on any Mada BNPL that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third-party rights.
We reserve the right to request that you remove all links to our Mada BNPL. You approve to immediately remove all links to our Mada BNPL upon request. By continuously visiting our Mada BNPL, you agree to be bound to and follow these Terms.
We also reserve the right to amend these Terms and its linking policy at any point in time.
If you notice any link within the “Buy Now, Pay Later (BNPL)” platform that you consider inappropriate or offensive for any reason, you may contact us and report it at any time. Such reports will be reviewed, and requests for removal will be assessed. However, we are not obliged to remove such links or to provide a direct response to each report. All submitted reports will be evaluated, and appropriate action will be taken in accordance with our applicable policies and procedures.
You agree to indemnify, defend, and hold Al Mada, its parents, subsidiaries, affiliates, any related companies, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them (collectively, the "Al Mada Entities") harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party arising out of or relating to (i) your access to or use of the Mada BNPL, (ii) your violation of the Terms, or (iii) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Al Mada reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us and you agree to cooperate with our defense of these claims.
You agree not to settle any such matter without the prior written consent of Al Mada. Additionally, Al Mada will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
PLEASE READ THIS SECTION CAREFULLY SINCE IT LIMITS THE LIABILITY OF AL MADA ENTITIES TO YOU. EACH OF THE SUBSECTIONS BELOW ONLY APPLIES UP TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. NOTHING HEREIN IS INTENDED TO LIMIT ANY RIGHTS YOU MAY HAVE WHICH MAY NOT BE LAWFULLY LIMITED. IF YOU ARE UNSURE ABOUT THIS OR ANY OTHER SECTION OF THESE TERMS, PLEASE CONSULT WITH A LEGAL PROFESSIONAL PRIOR TO ACCESSING OR USING THE MADA BNPL. BY ACCESSING OR USING THE MADA BNPL, YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS, INCLUDING THIS SECTION. YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS BY AGREEING TO THESE TERMS. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT ANY STATUTORY RIGHTS OF CONSUMERS THAT MAY NOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. THE MADA BNPL IS MADE AVAILABLE TO YOU ON AN "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE" BASIS, WITH THE EXPRESS UNDERSTANDING THAT THE AL MADA ENTITIES MAY NOT MONITOR, CONTROL, OR VET USER CONTENT. AS SUCH, YOUR USE OF THE MADA BNPL IS AT YOUR OWN DISCRETION AND RISK.
YOUR PURCHASE AND USE OF PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES THROUGH THE MADA BNPL IS AT YOUR OWN DISCRETION AND RISK. THE MADA BNPL MAY INCLUDE LINKS TO OR INTEGRATIONS WITH THIRD-PARTY WEBSITES OR SERVICES.
THE COMPANY DOES NOT CONTROL AND IS NOT RESPONSIBLE FOR THE CONTENT, POLICIES, OR PRACTICES OF ANY THIRD PARTY. ACCESSING SUCH THIRD-PARTY SERVICES IS AT YOUR OWN RISK.
NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED TO YOU BY A REPRESENTATIVE OF ONE OF AL MADA ENTITIES SHALL CREATE A REPRESENTATION OR WARRANTY.
TO THE EXTENT PERMITTED UNDER APPLICABLE JORDANIAN LAW, AL MADA’S LIABILITY FOR ANY DAMAGES SHALL BE LIMITED TO DIRECT AND ACTUAL DAMAGES RESULTING FROM A PROVEN BREACH OF ITS LEGAL OR CONTRACTUAL OBLIGATIONS. THIS LIMITATION SHALL NOT APPLY IN CASES OF GROSS NEGLIGENCE, MATERIAL BREACH, OR VIOLATION OF CONSUMER PROTECTION OR DATA PROTECTION INSTRUCTIONS ISSUED BY THE CENTRAL BANK OF JORDAN.
AL MADA SHALL NOT BE LIABLE FOR:
THE LIMITATIONS AND PROHIBITIONS OF LIABILITY SET IN THIS SECTION AND ELSEWHERE IN THIS DISCLAIMER GOVERN ALL LIABILITIES ARISING UNDER THE DISCLAIMER, INCLUDING LIABILITIES ARISING IN CONTRACT, IN TORT AND FOR BREACH OF STATUTORY DUTY.
PARTS OF THIS MADA BNPL OFFER AN OPPORTUNITY FOR USERS TO POST AND EXCHANGE OPINIONS AND INFORMATION IN CERTAIN AREAS OF THE MADA BNPL. HOWEVER, AL MADA DOES NOT FILTER, EDIT, PUBLISH OR REVIEW COMMENTS PRIOR TO THEIR PRESENCE ON THE MADA BNPL. COMMENTS DO NOT REFLECT THE VIEWS AND OPINIONS OF AL MADA, ITS AGENTS AND/OR AFFILIATES. COMMENTS REFLECT THE VIEWS AND OPINIONS OF THE PERSON WHO POSTS THEIR VIEWS AND OPINIONS. TO THE EXTENT PERMITTED BY APPLICABLE LAWS, AL MADA SHALL NOT BE LIABLE FOR THE COMMENTS OR FOR ANY LIABILITY, DAMAGES OR EXPENSES CAUSED AND/OR SUFFERED AS A RESULT OF ANY USE OF AND/OR POSTING OF AND/OR APPEARANCE OF THE COMMENTS ON THIS MADA BNPL.
AL MADA SHALL BEAR FULL RESPONSIBILITY FOR ANY DIRECT FINANCIAL LOSSES OR DAMAGES INCURRED BY THE CUSTOMER OR MERCHANT IN THE FOLLOWING CASES:
We reserve the right to modify, update, or discontinue Some services may be modified, restricted, or discontinued in accordance with operational requirements or regulatory instructions, with due consideration to notifying users of any material changes where reasonably possible.
The Terms contain the entire agreement between you and us regarding the use of the Mada BNPL, and supersede any prior agreement between you and us on such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms.
Any failure on Al Mada's part to exercise or enforce any right or provision of the Terms does not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
If any provision of the Terms is found to be unenforceable or invalid, then only that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
The Terms, and any rights or obligations hereunder, are not assignable, transferable or sub-licensable by you except with Al Mada's prior written consent, but may be assigned or transferred by us without restriction. Any attempted assignment by you shall violate these Terms and be void.
The user shall have the right to submit any complaint, objection, or grievance related to the “Buy Now, Pay Later (BNPL)” services through the official communication channels of Al Mada. The Company shall review the complaint and respond within a period not exceeding fifteen (15) business days.
The Company adopts a complaint-handling policy in line with the instructions of the Central Bank of Jordan, enabling customers and merchants to submit complaints through clear and publicly available channels.
All complaints shall be recorded in a dedicated system, and the customer shall be provided with a reference number for tracking purposes.
The Company undertakes to investigate complaints and respond within the timeframes required by the Central Bank of Jordan.
If the customer is not satisfied with the outcome, they may escalate the complaint in accordance with the mechanisms approved by the Central Bank of Jordan.
Where the Company’s responsibility is established, compensation shall be provided through one or more of the following:
Refund of any amounts incorrectly charged or deducted;
Correction or rescheduling of obligations without any additional cost to the customer;
Full cancellation of the affected transaction where applicable.
Any compensation shall be executed via the original payment method or an approved alternative method, with full transparency.
